Terms of Service

Please read these Terms carefully. By creating an account or using PolyQuest, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These Terms include a binding arbitration clause and class action waiver — see Section 16.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the PolyQuest platform, including the website at polyquest.polsia.app, its mobile applications, and all associated services (collectively, the "Platform" or "PolyQuest").

By registering for an account, accessing the Platform, or clicking "I agree to the Terms of Service," you enter into a legally binding agreement with the operator of PolyQuest ("Operator", "we", "us", "our"). You represent that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility — Age Requirement

You must be at least 18 years of age to use PolyQuest. By creating an account, you represent and warrant that you are 18 years of age or older. PolyQuest contains adult content and facilitates connections between adults in the polyamorous, ethically non-monogamous (ENM), and kink communities.

If we discover that a user is under 18 years of age, we will immediately terminate their account and delete all associated data. If you believe a minor is using the Platform, please report it to safety@polyquest.polsia.app immediately.

3. Account Registration and Security

To access most features of PolyQuest, you must create an account. You agree to:

You may only create one account. Creating multiple accounts to evade bans or restrictions is prohibited and will result in permanent termination of all associated accounts.

4. Acceptable Use — User Conduct

PolyQuest is a community-driven platform built on trust, consent, and respect. The following conduct is strictly prohibited and may result in immediate account termination:

Hate Speech and Discrimination

Impersonation and Fraud

Spam and Unsolicited Content

Illegal and Harmful Content

Minors

Non-Consensual Content

Platform Integrity

5. Content Ownership and License

Your content is yours. You retain full ownership of all content you create, upload, or share on PolyQuest, including profile information, messages, quiz responses, and any other materials ("User Content").

By submitting User Content to PolyQuest, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, host, store, display, reproduce, transmit, and distribute your User Content solely for the purpose of operating, improving, and providing the Platform and its features to you and other users.

This license ends when you delete your content or close your account, except where your content has been shared with other users who have not deleted it, or where retention is required by law.

You represent and warrant that you own or have the necessary rights to submit your User Content, and that your User Content does not violate these Terms or any third-party rights.

6. Account Termination and Suspension

The Operator reserves the right to suspend or terminate any account at any time, for any reason, at our sole and absolute discretion, including but not limited to violations of these Terms, conduct that we determine to be harmful to the community, or behavior that, while not explicitly listed, is contrary to the spirit of PolyQuest.

Reasons that may result in suspension or permanent ban include, but are not limited to:

We may, but are not required to, provide notice before terminating an account. In cases involving illegal content, safety threats, or severe violations, we may terminate accounts immediately without notice. We are not liable for any consequences resulting from such termination.

You may close your account at any time through the account settings. Upon closure, your profile data will be deleted within 30 days in accordance with our Privacy Policy.

7. Third-Party Interactions and User Safety

Important Safety Disclaimer: PolyQuest facilitates connections between users but is not responsible for user conduct, in-person meetups, dates, relationships, or any interactions that occur on or off the Platform.

PolyQuest does not conduct background checks on users. We do not verify the identity, age (beyond self-attestation), or intentions of any user. You engage with other users at your own risk. We strongly encourage you to exercise caution when meeting people you've connected with online, including meeting in public places and informing trusted friends of your plans.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

To the fullest extent permitted by applicable law, the Operator expressly disclaims all warranties, whether express, implied, or statutory, including without limitation:

Your use of the Platform is at your sole risk. We do not warrant or make any representations regarding the use of or results from the Platform in terms of correctness, accuracy, reliability, or otherwise.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator and its officers, directors, employees, contractors, and agents shall not be liable for:

In no event shall the Operator's total liability to you for all claims arising out of or related to these Terms or the Platform exceed the greater of (a) the total amount you paid to PolyQuest in the 12 months preceding the claim, or (b) one hundred dollars (US$100.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Intellectual Property

All Platform content, features, and functionality — including but not limited to software, text, graphics, logos, icons, quiz content created by PolyQuest, and the overall design — are owned by the Operator and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from any Platform content without our express written permission. Limited use of the Platform for personal, non-commercial purposes is permitted under these Terms.

12. Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, store, and share your information. By using PolyQuest, you agree to our Privacy Policy.

PolyQuest is designed for sensitive communities. We apply heightened protections to information about your relationship style, sexual orientation, and intimate quiz responses. See our Privacy Policy for details.

13. Paid Features and Subscriptions

PolyQuest offers optional paid features, including premium quiz access and other subscription benefits. By subscribing, you authorize us to charge your payment method on the recurring basis you select. All charges are processed through Stripe.

Subscriptions automatically renew unless cancelled before the renewal date. Refund eligibility is handled on a case-by-case basis; contact support@polyquest.polsia.app for refund inquiries. We reserve the right to change pricing with reasonable notice.

14. Modifications to the Platform and Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where feasible, notify registered users via email or in-app notification. The updated Terms become effective upon posting.

Your continued use of the Platform after any modification constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and close your account.

We also reserve the right to modify, suspend, or discontinue the Platform (or any part of it) at any time without notice or liability to you.

15. Governing Law

These Terms and any dispute arising out of or relating to them or the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Subject to the arbitration agreement in Section 16, you consent to exclusive jurisdiction and venue in the state and federal courts located in Delaware for any dispute not subject to arbitration.

16. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. This section requires binding arbitration for most disputes and waives your right to participate in a class action lawsuit or class-wide arbitration.

Agreement to Arbitrate

Except for disputes that qualify for small claims court or that relate to the enforcement or validity of intellectual property rights, you and the Operator agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Platform exclusively through final and binding arbitration, rather than in court.

Arbitration Process

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Delaware or, at your election, via videoconference. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST THE OPERATOR. All disputes must be brought on an individual basis only. You may not consolidate your claim with the claims of any other person, and may not participate in any class, consolidated, or representative proceeding.

Jury Trial Waiver

YOU AND THE OPERATOR BOTH WAIVE ANY RIGHT TO A JURY TRIAL for any dispute subject to these Terms, to the extent permitted by law.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@polyquest.polsia.app within 30 days of first creating your account. Your notice must include your full name, email address, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these Terms.

Time Limit on Claims

Any claim or cause of action you have against the Operator must be brought within one (1) year after the claim or cause of action arises, or it is permanently barred.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remainder of these Terms shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies posted on the Platform, constitute the entire agreement between you and the Operator regarding your use of PolyQuest and supersede all prior agreements, understandings, or representations.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
